HISTORY OF FEDERAL GUN CONTROL IN THE US

Second Amendment to the Bill of Rights

The Bill of Rights was Ratified by the States on December 15, 1791.   As you know the Second Amendment contains the language “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”  The revolutionary war was won, because those wanting freedom were armed.

Anti-gunners have long claimed that the Second Amendment is a collective rather than an individual right arguing the right to bear arms applied only to state militias.   Finally, on June 26, 2008 in the case District of Columbia v. Heller, the Supreme Court of the United State Ruled that it was an individual right.  Anyone who understands history knew this all along.

I should also state here that our Constitution did not create our rights.  They are God given and just put to paper by very wise and inspired men.   The following are short descriptions of the federal laws that have been enacted to restrict your right to Keep and Bear Arms and those who have put them in place.

National firearms Act of 1934

There was no requirement of firearm registration or control by the federal government until the National Firearms Act (NFA) was enacted on June 26, 1934.   It was supposedly passed because gangsters were using sawed off rifles and shotguns, and machine guns to commit crimes.   Back then the legislators knew they couldn’t get away with banning firearms outright, so they taxed them.   They slapped a $200 tax on all NFA firearms.  In today’s dollars that tax would have amounted to around $4,800 making buying an NFA firearm impossible for the common man.  There was also a requirement that the individual purchaser be identified.  This is done today with fingerprint cards and photographs of the buyer.   Here’s who enacted this law:

President:  Franklin D. Roosevelt – Democratic Party
U.S. Senate – Controlled by the Democratic Party (59 Democrats, 36 Republicans, 1 Farmer – Laborite)
U.S. House of Representatives:  Controlled by the Democratic Party (313 Democrats, 117 Republicans, 5 others.)

Gun Control Act of 1968

The next major piece of federal legislation regulating firearms was the Gun Control Act of 1968 (GCA) which was signed into law on October 22, 1968.  Among other things, it required Federal Firearms Licensees (FFLs) to obtain information from firearm buyers on a Form 4473.   The requirement for mandatory background checks was enacted in 1993 but wasn’t fully implemented until November 30, 1998.

By statute, the Form 4473 and information thereon is not to be accessed by the government unless there’s a criminal investigation or ATF comes to visit the FFL Dealer.  When an FFL goes out of business, his Form 4473 records are sent to ATF’s Out of Business Records center.    So, the federal government does have them at least if your dealer went out of business.    Most likely these records have all been illegally computerized.

I should also note here that the GCA created at “Sporting Purpose” test which allowed the government to prevent the import of certain firearms that the government felt had no “Sporting Purpose.”  (Where in the Constitution does it say that only sporting arms are allowed?)  The Act also prohibited the ownership of machine guns imported after the date of the Act and mail order purchases.  It also required recording of who bought ammo and too many other repugnant things to list here.   Let’s see who passed this massive infringement of our rights.

President:  Lyndon B. Johnson – Democratic Party
U.S. Senate: Controlled by the Democratic Party (64 Democrats, 36 Republicans)
U.S. House of Representatives:  Controlled by the Democratic Party (247 Democrats, 187 Republicans)

firearms Owners' Protections Act of I986

On May 19, 1986, possession of newly manufactured machine guns made in the United States by civilians was banned.   This Act did contain a lot of pro-gun legislation.   It protected interstate travel with firearms, banned the government from creating a national registry of non-NFA, firearms, restricted ATF’s inspection authority, allowed the interstate mail order sale of ammo, and more.  However, the Act did a horrible thing.

With the Hughes Amendment, it banned the possession by civilians of machine guns made in the U.S. after the date of the Act.   The Amendment was passed at the end of a session by a voice vote.  Charles Rangel (D-NY) was serving as the Speaker Pro Tempore of the House of Representatives.  He asked for a voice vote on the Amendment.  The Nays were audibly more than Yays, but he ruled in favor of the Yays.   He was asked for an actual count, he refused and ended that session.  We lost our right to own machine guns without a real vote.  Here’s who to blame for this one.

President:  Ronald Reagan – Republican Party
U.S. Senate:  Controlled by the Republican Party (53 Republicans, 47 Democrats)
U.S. House of Representatives:  Controlled by the Democratic Party (253 Democrats, 182 Republicans)

It should be noted here that the act of getting the Hughes Amendment into the Act was by a Democrat, however, a Republican President  signed it.  There was much pressure from the NRA to get this bill passed.  The NRA was fine with giving up machine guns to get some pro-gun measures passed.  Their actions paved the way to the next big assault on “assault rifles.”

Assault Weapons Ban of 1994

On September 13, 1994, the Public Safety and Recreational Firearms Use Protection Act, otherwise referred to as the “Assault Weapons Ban” (AWB) was enacted.  It banned firearms with certain features the government didn’t like such as pistol grips, folding stocks, collapsible stocks, bayonet lugs, and forward grips.   (By the way, in law school in 1988 I wrote a paper entitled “The Efficacy of Firearms Restrictions”.  In it I predicted the AWB.)  After 10 years of suffering through the AWB, it lapsed in 2004.  It was not renewed because there was no evidence that it decreased crime as promised.  You know who’s responsible for this one.

President Bill Clinton – Democratic Party
U.S. Senate:  Controlled by the Democratic Party (56 Democrats, 44 Republicans)
U.S. House of Representatives:  Controlled by the Democratic Party

ATF Not Enforcing Registration Requirements of NFA

The ATF’s Open letter stating that will not enforce the registration of Short Barrel Rifles, Short Barrel Shotguns, Any Other Weapons, and Suppressors.   This is the first time since the 1934 that we have regained some ground on our rights to possess certain firearms.  Who is responsible for this.  Let’s look at the political landscape and see who’s responsible for this.

President: – Donald J Trump – Republican Party
U.S. Senate: Controlled by the Republican Party (53 Republicans, 45 Democrats)
U.S. House: Controlled by the Republican Party (218 Republicans, 214 Democrats)

The reason the ATF changed its policy was the fact that the tax was removed via the Big Beautiful Bill and the President chose a great, pro-gun head of the ATF.

What's Ahead

The policy to not enforce the registration of NFA items is not law.  It’s a policy which can be changed easily.    We need to elect people who will enact pro-gun legislation and select pro-gun Justices to the Supreme Court.

If you’ve read the foregoing, it should be abundantly clear to you that the Democrats have always and always will vote to restrict your right to Keep and Bear Arms.   They’ve proved it time and time again.   They always claim that reducing guns will reduce crime.   They always go after military style firearms, even though they are used in a very small percentage of crimes while handguns are used the most.   Why is this?

Democrats and some Republicans don’t like the idea of an armed citizenry (King George didn’t either).   Tyrants don’t like the idea of the people being able to defend themselves or fight back.  They don’t care about your freedoms.   They love power.   They want to control YOU.

So, as you go to the polls, you should consider who will protect your freedoms the most.  Some of you are not liking President Trump right now and have told me you’re voting Democrat.   This is a monumental mistake.   Like Trump or not, he has done some things which in time will keep America prosperous long into the future.  I could go over why I think this is so here, but it would be a very long essay.

I’ve been dealing in firearms for over 40 years and have watched these restrictions pile up.   There’s one thing I am certain of.  If you vote Democrat during these Midterm elections and the next Presidential election, we’ll end up with more anti-gun measures than ever before. Whether a gun is registered or not, they’ll figure out a way to take if from you.

The Republican Party is far from perfect.  In many ways, it is just as corrupt as the Democratic Party.   This needs to change.  Voting for Democrats won’t fix things.  It will only make things worse.   Get involved and help fix things.

If you think the cost of things is bad now, it will get even worse and your dollars will be worth less and less.   Please consider these things.  I’m not asking you to believe me.  Do the research yourself.

PLEASE VOTE REPUBLICAN

May God Bless you All,
